Alrigthy, you might have seen some threads about it already and consider another one redundant. This thread is intended to collect information and document the issue. It's 'under constrution' and there's more to come. Please help! What happened On the 8th of December Next Island launched 2 days before the it was supposed and announced to launch. The only official information about this fact is a message on twitter on the 9th of December: "Psst... I know our official launch is Friday, but we're live and ready for pioneers on NextIsland.com" (Link) It was discovered that Next Island contains a large resort/theme park called Club NEVERDIE owned by NEVERDIE and featuring many items direcetly or indirectly named after NEVERDIE such as: - Club NEVERDIE (Teleporter) - ND 500 Raceway (Teleporter) - ND Suites - Venice (Teleporter) - Cheri Cove (Land Area?) - Taliesin Ridge (Land Area?) - Tina Lieu (Revial Point?) Additionally globals in this area state that they happened at Club NEVERDIE, example: "TRAIAN SENTENTZ STEFAN killed a creature (Pirate Skeleton Master ) with a value of 405 PED at Club NEVERDIE! A record has been added to the Hall of Fame." The problem There are several issues caused by this development: 1. In his role as a regular participant Jon NEVERDIE Jacobs just sold the original Club NEVERDIE located on Calypso for 635,000 USD. In his role as a deveopler he just introduced a new Club NEVERDIE which can be considered bigger and better than the 'old' one. There is a severe conflict on interest. You are either the politician deciding over the road to be built or you own the company that builds the road. You either play lotto or you are employed by the lottery. You are either are regular Entropia Universe participant/investor or you are involved in development. These kind of relationsships are regulated by law and monitored by authorities in almost every country of the world. It is common sense to avoid conflict of interest. And common sense should apply to Entropia Universe too. Incidents like this one are the reasons why the image of EU outside of EU is significantly negative and prevents potential participants in a number multiple times the current playerbase to join Entropia Universe. 2. NEVERDIE is on Calypso, NEVERDIE is ROCKtropia, now NEVERDIE is on Next Island too. 1 of 5 Next Island areas = 20% of Next Island is NEVERDIE. In addition to the fact that new planets in Entropia Universe are supposed to be different the Next Island storyline/setting didn't suggest that there could be anything NEVERDIE themed on Next Island. Playing games is not merely about clicking pixels of different colours but it is to a large extent about the meaning attached to the pixels. Anything NEVERDIE is associated with a hollywood - night club - celebrity - pop culture - get rich quick - context promoted by "the most famous and successful avatar of all time". Anything NEVERDIE does not fit to the majority of settings one could imagine and therefore is a major distractor for potential players interested in elaborated stories, in consistent settings and in immersive game worlds. Those issues mentioned under 1. and 2. are scaring off current participants (in a poll the majority voted for removing the ND theming) and are scaring off potential participants while handling business professionally and consistent settings would not scare off anyone but attract more people to Entropia Universe. Unfortunately it seems like the expanding Entropia Universe can not live solely from the non-caring which is a major problem and either has to adjust or is risking to vanish. The development Please correct anything wrong and add anything relevant that's missing! March 2009 (at the latest) - May 2009 (at the least): Info temporarily available on neverdiestudios.com for a rather short period of time before apparently all info hinting on anything NEVERDIE related on Next Island vanished from the official websites. "NEVERDIE Island known by the locals as "Kupu Wahi" also features an active volcano and is rumored to be the ancient burial island of the Aroa." "NEVERDIE Island's unique outdooe clubbing scene is poised to rival that of Ibiza and Miami." 28-29 April 2009 Booklet apparently given away by David Post on the LA Games Con 2009 probably containing the same info than the image above. "Over 300 of the most influential decision-makers in the games industry gather for the 2-day LA Games Conference to network, do deals, and share ideas..." (Link: LA Games Conference 2009) 4 December 2009 An email sent by David Post to people who registered earlier on the Next Island pre-lauch website contained a document also listing Next Island featues one of which was: "• Amusement park and clubs – Neverdie nightclub, Carolines Comedy Club" The document partially matched the press release published on the same day but not containing the list of features. (Link) 15 November 2010 Image on neverdiestudio.com discovered by RAZER on 15 November (Link) Description: Kupu Wahi is "also home to the second edition Club Neverdie." 22 November 2010 Screenshot showing a house with a Club NEVERDIE banner posted on Next Island facebook page on 22 November (Link) Description: "Maybe you've heard about Jon Neverdie Jacobs and his $635000 virtual nightclub? Here's Meg at Next Island's own Club Neverdie." 8 Dezember 2010 "So far, Post’s outside investors include Loeb Partners, former Merrill Lynch media analyst Hal Vogel, Katlean de Monchy, Jon Jacobs and an unnamed banker from Citi." from an article on venturebeat.com on 8 December (Link) Conclusion from this development The earliest official info on the studios website does mention Kupu Wahi as "NEVERDIE Island", half a year later and more than 1 year ago in an email it's a "Neverdie nightclub", and then almost a year later and 3 weeks before launch an image appears showing a house with a Club NEVERDIE banner. Before/after/intermediate announcements, press releases, video teasers and trailers, articles and interviews, the official Next Island website, the official Next Island forums, the Next Island Facebook page did not mention anything NEVERDIE related to make it's apperance on Next Island or NEVERDIE being an investor in Next Island.
Hi - can speak for Neverdie here - he is upset atm that the name change on the Asteroid has not changed , and it looks like Forma has yet to finalise his submission to MA for name change - i believe 'dont quote me please' that Jon is distancing himself from Planet Calypso to fully concentrate on his projects, the CND Asteroid Sale was suppose to be complete and the name change was supposed to be finalised before Next Island went live - everything went to plan accept the name change. I don't know whether that is failure on the agreement between Forma and Jon or MAs fault, But his new island/theme park was meant to become the new Club Neverdie, and to prevent conflict of interest with the Asteroid formally known as Club Neverdie. Again don't quote me.
An added post to the current poll - and this may break a rule - im sorry but i think this must be discussed because of this poll and people maybe voting A on false pretenses. No planet partner or member of a development team, Beta Tester or Community Representative has an advantage on the mechanics of the Entropia Universe. All submissions of Artwork. Mobs , Resources, Crafting Items, Missions etc. everything is submitted to the Balancing Team at Mindark with no say on the way the mobs HP - Regenerative capabilities - Damage Capabilities, every piece of Artwork and animation is submitted to Mindark's Balancing Team with 0TT and zero attributes, yes certain loot can be unique to a mob but relating to in-game mechanics no one has an advantage, not Neverdie, Enzo - no one. A planet partner can only request to MA by written submission if a mob is part of a storyline and requires more challenging attributes but Mindark can accept or reject the proposal - In regards to missions its very tough for every planet partner to create missions because of the RCE, reason why many missions have not yet been implemented by FPC, Rocktropia and the new Next Island is because they have either been rejected by Mindark or have further balancing issues that need to be addressed. between Mindark and the Planet Partner but NO in world mechanics are discussed. Mindark encourages current players inside the entropia universe to eventually develop there own worlds and become a Planet Partner (i know several people that have recieved their NDA papers iin regards to becoming a planet partner) but i cannot discuss that, but i can say is there quite a few players that are working on becoming Planet Partners (Dave "ozzie" and planet arkadia for example) , Does that give any rights to that player to keep playing his avatar that he has worked so hard building it up, as well as developing or managing a planet - of course it gives him every right and he/she should not be shot down by the core player base for making the Entropia Universe a better place, Mindark strongly encourages any avatar to play his/her part in the Entropia Universe - Planet Partner or not. Cheers:)
This is such a bizarre thing to say. I don't think Tass or anyone else would say that ND or other planet partners should be "shot down" because they are making EU a better place. Rather as Tass described (did you read the OP?!?!) Planet Partners should forfeit their participant roles due to conficts of interests. Clearly planet partners have several advantages over ordinary players due to their developer powers, this includes but is not restricted to: getting half the decay they use back, insider knowledge with respect to upcoming developments which may effect the market. At the very least, I'm sure Foma would have put some extra thought into his purchase if he knew another CND was going to be built and given to ND shortly after the old CND is sold. One might also wonder if it's fair for developers to be able to participate in certain gameplay mechanics like Land Areas, since as we have seen, they can just build themselves super land areas as they wish. It's insane power that no other player has access to, in particular I feel it is power that should not be held by someone with such a ridonkulous sense of taste.
I do see your point there - seems like they have an advantage over LA owners paying mega bucks for an LA and it seems the planet partners get there own LA for free, I would like to elaborate further but unless you have read the Planet Partner Agreement you dont understand the whole story, they have extremely strict guidelines to follow. And they could risk there whole planet if they break it.
So everything is slammed shut my MA and ND will not have any advantage for having a LA or Club or anything on Next Island, so ...... why have it in the first place???!! Seems to me it is there just for his ego and nothing more. This ND stuff has nothing to do with NI what so ever and doesn't fit the story line at all. This was the big turn off for me and the reason I will not go there even though I was really looking forward to it. Yes, Neverdie has done a lot for EU and Yes he took a big risk with buying the original CND and setting up a company and making his own planet and building one for David Post, but I think he has taken it one step to far now with the CND island. I think that EVERYTHING on a planet should fit the planet and/or the storyline and so far the new CND doesn't do either of those. OK, the new islands on Calypso have no purpose either and I don''t like them very much, nothing but a quick way to make lot of money if you ask me. So it is not just ND and NI, but all the 'live' planets so far that are disappointing me more and more.
I doubt if many people believe anything you say at this point. All the comparisons to other businesses are unnecessary when showing how crooked this whole thing makes MA and Neverdie look. I can give a clear cut analogy which would have people up in arms: What if Marco made an avatar and bought CP when it was up for sale?
Considering your descricptions of the processes and 'technical' details are correct I really feel sorry for planet partners. Considering your description of MA's policy regarding regular/official avatars is correct it is yet another field where they showcase a nonprofessional attitude. Fortunately some of their planet partners do not share this attitude: However, it seems you know more than most of us about the mechanics and therefore you also know that besides the systems you decribe as not manipulable there is a multitude of ways how someone would be able to take advantage. It is not the risk that someone would abuse his insights that is the problem, it is the mere fact that it is easily possible to abuse and that there seem to be no preventive measures. Not even talking about something like transparancy. As a matter of fact current as well as potential regular participants, investors and maybe even planet partners will be baffled and scared off when they come to know those issues or see pictures like this one: View attachment 432
Again id like to stress about the way i write things - Its not entirely MAs policy its my own interpretation of the policy through studying documents, memos, press releases, posts (official and not official), years of study and also reading the Planet Partners Agreement which is publically available through Mindarks office, nothing is written word for word - i never write that way, only my own interpretation simplifying for most to read and understand and mainly to help this community and paint a picture of the real situation. When i said 'i speak for neverdie' - but i realise he very busy and cant answer forums but i when we were discussing via pm that he realised there was fire on the forums regarding the CND Island - I just thought it was right relaying the information to the player community that he is unhappy that the Asteroid name has not been changed and its not his fault - the name change on the asteroid should have been done before Next Island opened so it does not conflict with each other.
The misconceptions... when in reality... Neverdie sold the astroid, specifical without naming. In his role as a developer he has made business arrangements with others to relocation the brand. There is no conflict of interest precisly becuase he sold the old Calypso based interest. i'm not a politian, nor a road constructor: im a user the roads. or maybe not. I'm neither a lottery employee or a player, some of which are winners. such narrow binary options are very very rare in real life. in successful business, development and participation go hand in hand. people in creative business are certainly involved in both the development and the participation in their own business and industry niche. its no conflict, on the contrary it is usually expected - can you imagine a musician who never goes to gigs? or a producer who never listens to music or only stays one studio with one act for their career? in fact, its often asked that MA developers play more to "eat their own dog food" as the saying goes. agreed, CND doesnt seem to fit into the new world, and also that the brand feels over exposed and tired within the Entropia Universe. however current participants are not the aim and frankly irrelevant to the new projects (they receive less revenue from calypso immigrants than from new participants) and new participants wouldnt know any different. yes it is a bit of a problem to have the brand plastered everywhere, but the solution lies in more seperation between the planets, so if you arent interested in NI and the Neverdie branding you dont need to see it while on Calypso. the objections raised need to be targeted at MA, to make clearer seperation between planets, not Neverdie and Next Island who are working with the system they have bought into.
It had to have been a very short time that the above photo was at the ND site, because I have never seen that before anywhere. It was never openly advertised, nor openly shared with either the community or the media in all that ND puts out into the universe to bring attention to himself. If he had, I'm sure there would have been discussion about it, but he didn't. Also, I happened to remember that back in 2009 after AHR asked me to join them and create news, I put together behind the scenes information as bonus content to give something extra to the community. I had approached ND about planet development and he started feeding me storyline that was definitely Next Island, but ... never did he ever mention anything about an ND island. Everything shared was all about the South Pacific environment from beaches to deserts, and the local cultures. This is where I say ... something is rotten in Denmark again.
The misconception... He sells something while creating something that devalues what he sold and you call that a normal business arrangement? Just because something is not prohibited by MA's rules does not make it acceptable. it's an outright do you seriously not see the difference between playing as a normal player (hunt, mine, craft) and build yourself an LA? lets take your example: sell a music label under the condition it is to be renamed => found a new label under the old name a month later => get your ass sued (especially juicy if both sides live in the us) MA dont need to reinvent the wheel, there are business laws and rules of fair practice. ND should get himself someone who studied business administration or seek the counsel of a commercial attorney and clear things up. noone needs the bad pr from something like this.
Agis, go away and research what a conflict of interest is then come back and comment. ND should be incredibly upset at his own ideals and stupidity in this whole fiasco. I will make it easy for you with some examples > http://www.google.com.au/search?q=c...&ie=&oe=&redir_esc=&ei=A8kCTfrhIsLTrQeI1pmRDw ND has several severe conflict of interest situations to resolve. Here is how a proper CEO of a planet in Entropia Universe handles it, knowing the legal challenges he can face not doing so. The rest of what has occured with regards to Next Island in my mind is a joke, However that is ND's business with David Post and MA. It is very bad business ethics to pull the stunt he has with selling CND with a new one opening up on a world that is not even his. He is a participant and he is getting paid for the revenue generated as a participant owner. ie. Taxable Land Area Rather than a profit sharing agreement with David Post on the whole land area. CND should not even exist at all, it in itself is a conflict of interest upon Next Island.
without further evidence of expertise, I call this speculation or at least unqualified heresay Better way to have done this would be something to the effect of "when I was pm'ing with ND recently i got the feeling that he was not happy......" , else you appear like a self-aggrandizing fool.
It really looks like you are in general disagreeing that something like conflict of interest exists at all. Being a regular participant in Entropia Universe and at the same time a developer of several planets as well as a planet partner should actually be a prime example for conflict of interest. So I really wonder what you would consider a conflict of interest at all In the end it doesn't even matter whether or not this setup can be considered a conflict of interest by academic definition or in common sense. As long as it is perceived as a conflict of interest or a significant number of people are concerned about the situation actions should be taken accordingly. It shouldn't be too hard for MA to set up policies and restrictions as well as methods to monitor them and make all of those transparent. Example: As soon as you become an employee or contractor your regular avatar gets 'frozen' and you are only allowed to use an official avatar that cannot withdraw, drop items, trade, ...
Some very good points about conflict of interest were made by mujukis in a PCF thread here and here ... it's worth reading. Some people just don't get it.
To be honest, I am totally put off by this, not that anyone would or should care, but I think others are in the same boat. When ND sold CND on Calypso, I said to myself, this guy is honest in making an attempt to clean up his act, then he pulls this stunt; lol and more lol, no more to say. Your right MS9 some people just don't get it. Now its a sit and wait and see if he sees the light or if the other partners are going to put up with his shit. His stunts effect the whole universe, he is a greedy self righteous prick in my books who has little regard for the universe's success as a whole. That may have sounded a bit harsh but it is truely how I am starting to feel about the guy now. Let us face the reality, MA just turns a blind eye, ND has done a lot for the universe, just they haven't woken up to the reality of it being "mainly" for the worst in external media sites. Talk about stepping over the line, at least he did it in a big way lol
no, i see exactly the difference between participant and developer. im also saying there are more layers unlike Tass's vision of corporate corruption where only developer and commisioner exist. as for your music label, that sort of thing literally happens all the time, unless the label buyer puts in place a non-compete agreement. the name was specifially not part of the astroid trade, so why the surprise? of course conflicts exist, i just dont think ND moving his IP from one world to another is one. being a participant as well, now that does raise a conflict. But when was the last time you saw his avatar's name in chat gloabling? is he actually activly playing rather than existing for administration/information? this needs to be addressed seperatly from the dealings he might have as a developer. i think the underlying reason people are pissed is because they didnt know. when people used to speak of NI being barbie land and social networking focused, i dont know how we didnt see that this would be a more obvious location for the whole Club Neverdie concept to be.
