Nice graphics :) I really enjoy the new scenery. I'm aware that NEVERDIE Studios is developing Next Island, but frankly, it's kind of dissappointing to see that when one travels to Champion Beach, there's a big message stating "NEVERDIE Champions Park", with a TP called "Club NEVERDIE", Eclipse Cove being in a zone called "Cheri Cove", there being a healer called "Tina Lieu" etc., etc. Why can't Next Island be a seperate entity altogether, without Mr. Jacobs naming stuff after himself? The Crystal Resort TP might be bugged. I fell straight through it when I TP'd there. The second time it went better. Th e same happened at the Hidden Beach underwater Passage. "Jungle of Dream Ruines" - I assume "Ruins" was intended.
You can see my comments here ... and I agree 100% ... incredibly disappointing to discover that at least 6 teleporters are ND-related, as well as these other areas that I've learned about. This is not "Next Island" ... it's "Next Neverdie" ... and to me, that just totally destroys David Post's vision for this planet, and I have no idea why this was even allowed, especially since David said that he financed the majority of the initial development himself. Even if ND had made some kind of investment in this venture, it's not his planet, nor should there be anything ND-related on it. The planet is no long a pure vision, but an invaded one. :(
Yeah. I went to Surfers Paradise - and after seeing, that I'm on CND2 I left to the main land. As I said before: THIS IS NEXTISLAND!!! NOT CND!!! So, I'll explore the rest, but the ND part is off limits for me.
Your sarcasm is getting old Stave ... the support for the comments about how Next Island was opened up today are quite evident here and in other threads at EP and PCF. I respect that you have your own opinion about this, but please respect that many of us are on the same page with regard to how all of this was handled ... very poorly.

It's interesting how participating in discussion where many others share the same thoughts is considered whining. I'm merely responding to what people are writing, but find that I have to repeat myself sometimes because people aren't reading what others are saying to get the full impact of the discussion. Think what you want dilly, it's not whining, it's speaking to the facts of the events that have occurred over the past few days, and many in the community have raised some very valid questions, to which I have responded. If it bothers you so much, then please put me on ignore.
What I gather from what you have been saying over the passed few days is that you are against Neverdies participation in Next Island, and you are against his naming areas after himself, and his family members. What everyone else has been trying to tell you is that Neverdie owns an Island on the planet, but it is just a very small part of the planet. Try looking at the map first of all, notice there is quite a considerable size difference between Neverdies Island and the mainland. Then also consider that Next Island has not yet released its mainland content, furthermore the Amazon, Ice age, and Ancient Greece lands have not yet opened. So how big really is Neverdies share of Next Island? Sure, its easy to get the impression Next Island is dominated by Neverdie, because Neverdies content is the only content currently available! Curiously you act surprised that Neverdie owns an Island on the planet at all.. even though it was announced that he would nearly 2 year back... I would have thought that with all this you would at least be able to acknowledge that Neverdies share of Next Island is not as big as you think, but curiously it would appear not...
Dilly, you're missing the point ... it's not that he has an island with his name on it, or that areas are named after him or his family, and it's not the size of the island, and I never said anything about Neverdie dominating the island. Please take the time to read what I have written in context, and the real explanations that I have given, rather than the words that you are twisting to suit your posting. That's all I ask.
It was announced 2 years ago that Neverdie would have an island on the planet. I'm sure I dislike Neverdies ego just as much as you, but I can acknowledge that's it is just a small area of the planet. if I don't like something or somewhere, I don't complain in the forums, I just don't go there.
Well, like it or not neverdie's presence has been established with his usual subtlety. I don't need to go to his island, and I won't. I am just curious to see how he'll slap the neverdie brand on ancient Greece.
Entropia EULA Section 8 a. "You may not take any action, post, communicate, upload or otherwise us any content to threaten, harass, cause grief or distress to any of MindArks employees or agents of MindArks affiliate's employees or agents in or outside the Entropia Universe, including, but not limited to, IRC channels or public web forums." i believe all the stuff you and your community have been saying on the FPC forums, EP forums, here, and what other forums count as breakage of this part of the EULA. so when i can find out where to send the right support case to report this, and all the neverdie stuff you guys made fun of on the other thread, i will request to have this stopped and dealt with. these repeated posts do nothing to get things solved, this is doing more harm then it is good. oh and mindstar9, you are responding to posts, that were responding to what you initially posted, so dont try and back out like its somthing that you didnt start. and you are finding that you have to repeat your self because people have enough sense to not beleive in your view points. please i ask again, just let this stuff go, it is not doing anything good for the community. EDIT: i realize that the EULA rule does not implicitly say planet partner, but are planet partners not an affiliate of Mindark? and if they are not protected under this part of the EULA i believe they should be.

Should MA actually try to enforce this against an entity willing to take them to court over the implications of this statement they will find themselves on the paying end of a settlement much as Linden Labs has had to do in the past. All things being set aside here though, the branding of peoples first impressions of Next Island as NEVERDIE has been what has occurred here. Now Im not privvy to how Mr Jacobs got paid, but Im assuming he got paid in part for his labors by this collection of land areas and the customizations. This is all well and good, and its his right and Next Islands right to negotiate the terms. However I did find the introduction of NI and branding to be in poor taste as a result of the realization of those terms. Im hoping Greece and other time destinations do not share this branding.
Section 8 of the TOU is largely unenforceable. The rest of the document is not quite so vague. Its all in how things are said. Basically section 8 says "if we dont like what you say we can boot you for any reason." That is corporate lawyer talk and as Bragg vs Linden Labs illustrates, phrases like that have very little value as they fail to honor implicit expectations provided by the day to day service. I only bring this up because I've seen people attempt to bully others with the TOU on Calypso. It caused alot of negative feelings, and caused me to consult legal advice before proceeding with my continued involvement with the platform. Simply put, for everyones peace of mind the TOU should probably not be taken so literally. It needs revision and modernization.
Well it is TOU Terms of USE.. Meaning if you use this product.. You agree to fallow these rules. It is a legaly binding agreement between the user and the product maker. If said agreement is breeched.. then you agree to the consiquence's set forth. It is Possible to Enforce said usage termination by it being implemented into the software (Admin Tools). Now with that on mind is there a legal Remidy? who knows? I'm not a lawyer.. But sure looks like users should agree that upon breech of TOU that they wave any and all legal remidies for breeching said agreement.. Hey if I was MA.. I would tellem hey it is there money invested in NI, Not yours.. there are other planets.. don't like it take the 40 ped shove off.. they can do with there money what they like.. Just like you.. I dont think this really has anything to do with Next Island proper. The legal issues are with the EU TOU, not Next Island itself. Basically the rules they wrote sometime in 2003 have remained stagnant while the world has moved on. Important legal decisions have been made based off statements like those made in Section 8 of the TOU here which basically neuter those statements. Also claims made toward forfeiture of rights or binding arbitration have been reviewed, and found to be in favor of removing said clauses. Basically, the way the legal landscape is taking shape players are fast no longer becoming required to sign away their rights as citizens of their natural born country in order to participate in lands like Azeroth, Britannia, and whatever that space is that Second Life seems to reside in. Statements to the contrary are becoming the provender of backwoods thinking. But we're missing the point here. This thread isnt about the EU TOU. I simply wanted to make a point to those who would use the TOU as a yardstick by which to gauge the validity of expressions of public opinion.
