Neverdie Studios Avatars to retire

To be honest this is a tough spot for NEVERDIE. In essence he has been told to give up every piece of taxable land and real estate he owns, becoming purely an outside observer with limited interactivity through the avatar NEVERDIE.

All things being said and done, such actions work against the interests of Entropia Universe as they take one of the biggest proponents of the platform and adopt an adversarial stance towards him living out his virtual world "American Dream."

Sad for EU. Sad for NEVERDIE. The only people celebrating anything here are those who revel in the destruction of happiness and the containment of creativity.

personally I think its sad. Its a huge loss for the ones affected. Being able to play just because you LOVE TO PLAY. All the hard work put into the avatars, ect.
Time will tell I guess....

Man this really sucks. Expand the universe and you can't enjoy it. Follows is a post of mine from PCF'
"I personally would not invest my own time and money into expanding this universe if I could not enjoy it.
If Planet Partners could make their own rules on what they and their employees could do this would be a brief example of what I would have.

1)Employees would be required to play the game.
2)Employees would have their hunting and mining expenses covered by me.
3)The names of these avatars would be made public.
4)All loot they acquire is to be turned over to me.
5)Said loot is to be used in events/free giveaways, at no point can it be sold for profit.
6)No employee can play the game for 24hrs after a new VU is released. If the VU included new items, employees can not play until the items are found, or 48hrs.
7)Only exception to rule six is if bugs are being reported, then they are to log in and investigate those bugs.
8)Employee's are required to have gold cards, these gold cards are to remain at work so they can not log in at home.
9)Any employee caught playing from home, or leaking information will be fired immediately. They will also be charged with breach of contract.

Well I didn't want to see this happen..But have my reasons why I think it may be more of a benifit. These people get all involved in other players and there soc's and there politics within a soc.. meaning to or not. I happen to like ALL of the Neverdie Team. Even Farce(Force) and I think the reason me and him have had such a rough go is because we are alot alike. However I have seen favoritism. I have also been in my first event on NI and lost 3rd place to ND himself in his own event.. Wich I thought was Bullshyt, yet a honor.. Now claiming Rocktropia as my home and having a star on the walk of fame right next to Neverdie's put this planet in special place and concern in my "Life" because I am my Avitar. I have seen the I AM A DEMIGOD as discribed by farce in ND's movie clip in these people. It has hindered my soc's growth. It has also put me in a position to vacate NI and Rocktropia because my Avitars loss in everyway has been to one or more of the ND teams avitars gain.. Well I don't come in and play a game that is supose to pay me to play it.. To be in Direct compition with the developers that.. 1.Have way more funds than I have to compete with. 2.Have a higher cost to operate my avitar on there planets. 3. Be dressed down by them when I try to help them.. All of this is Bad Politics,Bad Game form,Bad for growth,Bad Game Balance,Bad for my gaming growth..Now saying all of this, Will put a BAD rep on me but is the truth & that is me..Sorry to see you guys go.. 1) To be honest, youre also in competition with players who have way more funds than you have to compete with. Picking on a developer for having more money than you is an opportunistic argument and has no basis in reality. A developer may have inside knowledge on how the system works, or on what items are coming out when. But what they dont have is a magic switch that says "I win all the time." MindArk has repeatedly stated that they control loot balancing.

2) Your cost to operate your avatar is your own business, same as it always has been. Yeah I know youll probably say blah blah blah 80 ped to go get items from Calypso... but the truth is thats there in order to curtail flooding from Calypso to other planets and vice versa. These are separate business ventures held together by a common platform and currency exchange. You arent meant to travel to and fro at a whim. Commit to a planet and its resources or pay the cost for your desire to remain free of any sort of tether. Again this is nothing more than an opportunistic argument, existing only because of a users failure to recognize the nature of the platform.

3) Dressed down? Im not sure what this means, but it sounds like you believe you've been talked down to. Given the opportunistic arguments above I'd say that without any proof this is probably just more of the same.

Im not a personal friend, or even an associate of any of the NEVERDIE avatars. NEVERDIE to date has not had a single continuous exchange with me, perhaps saying hi and moving on to more important things to do. Im not even sure who is other associates are, and were it not for the NEVERDIE tag above their head Id probably consider them just another player on the block. Im saying this so that I can establish that number one -- Im not a NEVERDIE or MA fanboi, and number two -- Im open and given to criticise anyone when I think they are in the wrong.

I think you are in the wrong right now. Not because you support MA's decision, but because of the reasons why. Theyre flimsy, circumstantial, and selfish.

Opportunistic arguments are bad business. So is making the same post in 2 different threads. This is the 2nd time youve done this. Why do you do it?

Actually, disregard this. I dont care. This is just going to turn into a troll war and I want no part of it. I simply get irritated at the irrational arguments people put forward as gospel truth on these boards, and that other people, too lazy to do their own research or too disinterested to speak out against the trash being spewed forth, allow to go on.

Fact - ND and staff were contractually obliged to retire their personal avatars. They knew this when they signed the contract allowing them to build/own RT.

Fact - they did not do this.

Fact - they have been reminded by MA of their obligations. MA should have enforced this action around 9 months ago when RT opened, but they didnt, and now that people have "brought it to their attention" they have no choice but to enforce it.

ND is not stupid, he is a very successful businessman and very familiar with contracts and the concept of conflict of intrest. He and his staff have had their avatars 9 months longer than they were allowed and appear to be trying to shift blame by saying that this has just been brought to their attention.
Do you really believe that ND signed a potentially multi million dollars business contract without reading or understanding it? Do you think his Lawyers missed it too?
He took advantage of MA's reluctance or ineptitude in enforcing a contractual obligation and continued with his avatar longer than he should have. Now he has been asked to fulfil his obligation he is claiming that he had not done so previously because he didnt know he had to.

I understand his reluctance, he has put a lot of time and effort into his avatar, but when he signed that contract he made the choice that the business was more important than his personal avatar.

There's a really simple fix for all of this.

Create a company. Call it the NEVERDIE Foundation. Give all ownership of avatars and their property to the Foundation. Donate the profits to a charity of your choice, or put a few charities up on the website and allow players to select who gets the donation. Write the taxes off of NEVERDIE studios.

Legal and binding conflicts of interest solved. The Avatar may be controlled by a human, but it is being operated on behalf of the foundation and is therefore no longer the legal property of each individual involved.

 

well i for one will miss neverdie and his staff coming in game and playing in the pvp ring and the events they do.

its a shame that some are doing this only because they can, and because they have a stick up there ass.

well to those people who raised there pitchforks, a big fuck you for ruining future evolution, and big fuck you for ruining a good end to the year.

Nor has FPC - ND (and co.) is the first to publicly say he is retiring his avatars. No word from FPC who have blatantly said in the past they play under normal conditions but cannot withdraw PED, still undrestricted play.

If you do not work for MA, or for ND, or were involved in the agreement process or unless you were told each and every one of these 'facts' directly from ND or MA - then this is all second hand smoke, he said - she said.

Big-nosing yourself when you arent involved is petty.

FPC are MA employees under a different guise. Are they under different contractual obligations? They should know the EULA better than most. Seems like a double standard to me - were MA going to remind FPC employees too.

Such a one sided argument Tayz. ND is not the only planet partner. FPC are MA and they cant even follow their own rules.

This is the correct argument, M. I sense this is nothing more than a move to appease some planet partners who have been asking questions. NEVERDIE has not been targetted for having an avatar. Hes been targetted for PUBLICLY having an avatar. If it were truly an issue MA would have been much more hard line about it 9 months ago, not even allowing the avatars to set foot on Rocktropia. If perchance a new planet partner started asking questions about planet owners taking an active part in influencing the economy and raised concerns of conflicts of interest this potentially could result in a knee jerk reactions such as we see here. Or if perchance a group of players started receiving anonymous complaints and information, and were subtly encouraged to take the battle upon themselves, this too could potentially cause an uproar as these players file numerous support requests asking for official answers to their newfound questions. Ive received my share of anonymous communications regarding affiliations existing in this game. Its the nature of having a website that is actively promoting game related news. These things are possible.

Not that Im saying this did happen. Im simply saying it is more feasible than say a corporate entity getting suddenly angry at a planet partner they have a lonstanding relationship with for not observing parts of the EULA the parent company seems content to disregard themselves. To me an external force backing them into a percieved corner sounds much more likely.

but there wont be any uprising ever again like there was with this unless its more neverdie stuff on other planets.

this was about neverdie in the begining, and will always be about neverdie only in the minds of those attackers.
