MindArk PE AB(publ), 556640-4769, and , 180775-13054, have agreed on the following


Settlement Agreement


has initiated legal action against MinArk at Göteborg tingsrätt (Case No T 13473-08). claims that MindArk must pay damages of USD 303,808 because MindArk has barred from Entropia Universe.


MindArk has contested charges. MindArk claims in the same case that must pay damages of SEK 175,000 because of violation of copyright and breach of contract.


The parties have now made the following settlement.

1. admits to having violated the EULA through the use of an illegal third party program.
2. admits to being behind and being in control account.
3. MindArk shall as soon as possible convert the assets on accounts to PED through the auction system in Entropia Universe.
4. must pay damages to MindArk to an amount of 60 per sent of the PED amount available accounts after MindArk has converted all assets on the accounts to PED according to 3. MindArk then has the right to immediate payment of the damages through transfer of the amount from accounts to MindArk.
5. has the right to withdraw the amount left accounts six months after MindArk has converted all assets on the accounts to PED.
6. is responsible for the risk of possible charge backs made from credit card transactions through which the assets on accounts are converted to PED through the auction system of Entropia Universe.
7. MindArk has the right to publish the following or similar information about this settlement:

1. • that MindArk has barred players because of the use of illegal third party programs.
     
     
   • that the player has admitted to it and accepted MindArk’s decision
     
     
   • that the player has paid damages to MindArk
     
     

1. undertakes not to divulge the contents of this settlement agreement to third party. If violates this secrecy clause, he must pay a fine to MindArk of SEK 25,000 in each case.
   
   
2. MindArk barrs permanently from Entropia Universe. undertakes never, directly or indirectly through the use of someone else’s registration information, to register an account in Entropia Universe.
   

 

 

This was one of the offers made but not the agreement signed and so not confidential, another settlement was agreed at a later date. I was banned at PlanetCalypso for duplicate account even though I do not have any existing account there. More details can be found by requesting it from the courts.

So in the end nothing from these profits end up back in at the community, most items will press even more on the game in a sense of advantages it has over (L) equipment.
Not forget in most cases the acquiring from these items impacted mainly the community playing honest and not MinkArk leaving leaks and bugs for exploiters.
